Throwing of Jamaratul-Aqaba on the Day of Eid and throwing it on the eve of the first day of the days of At-Tashreeq. Hastening the throwing of the pebbles during the days of tashreeq before mid-day and the rule of throwing during the nights of the days of Tashreeq.
Opinion of The Council of Senior Scholars no.3 date: 13/8/1393. A.H.
All the praise and thanks be to Allah Alone and the peace and blessings of Allah be upon the holy Prophet, his family and companions. To proceed:
The following verdicts are based on the opinions of the council of senior scholars in its second seminar held in the month of Sha’baan 1392 .A.H on the following issues:
1. The rule on throwing Jamaratul-Aqaba before sunrise on the Day of Eid.
2. The rule on throwing jamaratul-Aqaba on the eve of the first day of Tashreeq.
3. The rule on throwing of pebbles on the Days of tashreeq before mid-day.
4. The rule on throwing of the pebbles of the eves of the 2nd and 3rd days of tashreeq.
The council, after an in-depth study of the issues mentioned above and a thorough consideration of the sayings of scholars on them, took decisions as follows:
1. It is permitted to throw jamaratul-Aqaba after a half of the night had passed, and this is for the weak ones among women, the aged, the excused and those who take care of them. This is due to the traditions reported to that effect.
2. Impermissibility of throwing the jamaraat before mid-day during the days of tashreeq due to the actions of the Prophet(may the peace and blessings of Allah be upon him) and his sayings when he said: “ take(learn) from me your hajj rites”. And also due to the saying of Ibn Umar: “we used to get ready for throwing the jamarrat and when the sun reaches the mid-day we then go to throw”. As it is known, the holy Prophet peace be upon him is the most knowledgeable of all people and the kindest of them, if doing so was allowed, he would have made it clear.
3. The other issues mentioned above are among issues of difference of opinions and hence, it behooves the individual pilgrim to follow what the holy Prophet peace be upon him did in that regards as he said: “take from me your hajj rites”
The council sees it appropriate that, one should seek a juristic opinion from whoever he trust and then act accordingly.
To Allah belongs all capabilities and may peace be upon the prophet Muhammad, his family and all companions.
